Important Cell Tower Legal Decision

A U.S. Court of Appeals ruling filed Monday means AT&T will not be building a "monopole" cell tower near the Masonic Lodge on Fort Hunt Road.

Though more cell phone tower applications in Fairfax County have been accepted than have been rejected, the case has reaffirmed the power of a vocal minority to put a stop to construction of telecommunications infrastructure in their neighborhoods.

The U.S. Court of Appeals for the Fourth Circuit affirmed a lower court's decision upholding a decision by the Fairfax County Board of Supervisors to prevent construction of a cell phone tower. The appellate court filed the ruling Monday in the case of New Cingular Wireless PCS, LLC, d/b/a AT&T Mobility v. Fairfax County Board of Supervisors.

In a statement, Mount Vernon District Supervisor Gerry Hyland said, "This decision helps make the matter settled law that communities are in the driver's seat when it comes to the location of telecommunication facilities."

The case stems back to 2009, when the Fairfax County Planning Commission recommended Cingular's proposal to construct an 88-foot monopole designed to look like a tree near Masonic Lodge to the Fairfax County Board of Supervisors. But local residents said that the proposed pole could depress local property values, and that the facility was not in harmony with local zoning laws.

The Board denied Cingular's request by a 6-2 vote, prompting the original lawsuit. In November 2010, the U.S. District Court for the Eastern District of Virginia in Alexandria issued a ruling upholding upheld the rights of local residents to oppose land permit applications for the construction of cell phone towers.

The lower court found that the Board of Supervisors had reached a "reasonable decision" to deny Cingular's land use application based on community opposition.

Cingular subsequently appealed the decision.

When the Kasliwal brothers (Sanjay and Sudhir) were diagnosed with brain tumour and their dog was diagnosed with stomach cancer within a gap of a few months, their doctors advised them to look out for mobile towers in the neighbourhood. They suspected radiation from mobile towers to be a possible cause for cancer.

What was found was quite alarming. There were antennas of various mobile companies installed on a tower at a distance of mere 20 metres from their house. On measuring the radiation levels, the levels were found to be quite alarming. When the word spread, others came forward and it was found that there were seven cancer cases in the vicinity.

DECT Cordless Telephones

All the big box stores sell only DECT cordless telephones. DECT stands for digital enhanced cordless telecommunications. The variant used in the US is DECT 6.0 which transmits at 1.9 GHz. The base transmits continuously. An AM radio howls near them and RF detectors can measure the RF exposure. Simply removing or replacing the phone with a non-DECT phone has "cured" cases of chronic fatigue syndrome, fibromyalgia,, insomnia, depression etc.

A 59 year old woman told me yesterday that she slept through the night for the first time in over 2 years the first night without the DECT phone. Back and leg pains and depression also disappeared in a day. Her report was unsolicited.

Like Sarah Vatnsdal (Coast Reporter letters, March 16), I too saw my Hydro bill suddenly increase when my smart meter was installed.

I'm a very careful user of electricity, and normally pay Hydro $120 to $150 for two months. Yet my first two-month bill after the meter was installed was for $248 — double what I normally pay.

I cut back on heating even more, but the next two-month bill still came in at $200. Something is clearly wrong with Hydro's billing, and the problem corresponds exactly with the installation of the smart meter.

I am not against smart meters, but I am against smart meters that don't work and whose errors cost me money.

I would like the group organizing to protest against unexplained jumps in smart meter billing to identify itself, preferably with a website, so those of us affected can organize to approach Hydro collectively and in a more formal manner.

Virgin Media Wi Fi Dangers

Dear Kevin,
Having watched your conference video re: VM rolling out wifi across our towns and cities. Obviously from from a technical and business perspective it could be viewed that this project has great merit in providing wifi to the many millions of people who want to use this technology. However I would like to bring to your attention the plight of hundreds of thousands of people who are currently suffering terrible health effects from exposure to this technology and find it absolutely impossible to stay in an area where wifi is used.

Many thousands of people are being driven from their homes and have had to quit their jobs because of the installation of wifi hubs, masts, DECT, and mobile phones.

The World Health Organisation has classified EMR as a 2B carcinogen. There are now hundreds of scientific papers proving beyond all doubt that wifi and other EMR sources damage the immune system and DNA, and cause serious irreversible biological damage that transcends through conception to the next generation. No one has been exposed to this to this technology for an extended period of say 20 years, so no one can safely say what the long term health effects are. Without understanding what exactly the effects of long-term exposure to this technology are, it would be totally irresponsible, moreover negligent to bombard the population with compulsory wifi.

Unfortunately the uninformed, out-of-date and incorrect statements issued by the HPA, ICNIRP and other organisations who refuse to accept any of this evidence, preferring instead to bow to the commercial pressure to further the development of this technology are misleading the public. It is very easy for politicians to use HPA/ICNIRP guidelines in order to 'dodge' supporting the precautionary principle recommended by the Bio Initiative 2007

My question to you is; what provision is Virgin Media going to make for the hundreds of thousands of people who will be driven from their homes, places of work and be adversely affected by the wifi installations you propose to put up? These people already find it almost impossible to go into their town, village, Post Office, Community Centres, schools, medical centres etc, without the installation of even more wifi devices. There are people with heart conditions, those fitted with pacemakers and other electronic devices, implants that will facilitate the emitting of secondary frequencies as a result of exposure to wifi and others that suffer from Electro Hyper Sensitivity. Are you going to leave them with no choice but to leave their homes and stay away from their communities?

There are many thousands of sources of evidence, but if you just visit www.magdahavas.com you will find the evidence and links to vast volumes of other information confirming the dangers of wifi.

Unless we have reached the stage where Virgin Media is only interested in making money at the expense of the health of the people, I respectfully ask that you consider reviewing your strategy in order to make provision for those that cannot, or do not want to, be exposed to wifi. Is it Virgin Media's intention to let them suffer or force them out?

Make no mistake just quoting the HPA/ICNIRP guidleines 'There is no evidence....' etc, will not solve this problem.
